Divorce Over Sexual Incompatibility

When filing for divorce in New Jersey there are many reasons that can be set forth. In some cases, the reason for the filing is obvious and it is a “fault” filing. These reasons can include: adultery, desertion, extreme cruelty, addiction, imprisonment, institutionalization, abuse of a physical, emotional or sexual nature, or sexual deviant behavior.

If the filing is made due to “no fault,” then it is likely that the petitioner will cite “irreconcilable differences” as the reason. In order for irreconcilable differences to be accepted by the New Jersey courts, the couple must have issues that have gone on for the prior six months that make salvaging the marriage improbable. While not as prominent as adultery, physical abuse, addiction or imprisonment, sexual incompatibility is a legitimate reason for people to choose to end a marriage. There can be many reasons that this can happen to a marriage. Research into biology has indicated that a difference in the ages of the couple of ten years can eventually give rise to the problem of sexual incompatibility due to changing needs and desires. At some point, what the couple wants and needs will become out of sync and cannot be repaired no matter what they do. Sexual incompatibility might have something to do with not being physically attracted to the spouse any longer because of weight gain, changes to the body or the disinterest of him or her trying to be attractive any longer.

In certain cases, sexual incompatibility is a precursor to other reasons that couples wind up getting divorced. For example, if a husband or wife isn't getting what he or she feels is needed at home in terms of love and affection, there is the temptation to go and get it elsewhere leading to infidelity. While the problems in the home are obvious, that doesn't mean that the husband or wife would be okay with his or her spouse fulfilling sexual needs with another person.

In other instances, the sexual problems can spur abuse, drug use, alcoholism or deviant sexual behavior such as spousal rape. It's not simply about a problem in the marriage with achieving sexual compatibility, it can lead to other issues that spiral out of control and contribute the ending of the marriage.

While it may not be high on the list of reasons for a New Jersey divorce, sexual incompatibility is real and can happen. Marriages can end because of it or the actions that a member of the couple will take to alleviate the stress that can accompany not being satisfied sexually such as committing adultery.
